Terms of Service
Last updated:
These terms are the agreement between you and Alcove (usealcove.app), a focus timer for planning and tracking your work. By creating an account you agree to them. How we handle your personal data is explained separately, in our Privacy Policy.
The short version
- You need to be at least 13 to use Alcove, and to have a parent's or guardian's permission if you're under 18.
- What you create in Alcove is yours. We only use it to run the app for you.
- Be decent: no illegal use, no abuse of other people, no attacks on the service.
- The AI assistant can be wrong. Its suggestions only change your routines if you apply them.
- Alcove is free while it's in beta. We'll tell you at least 30 days before any feature needs a paid plan.
- Paid plans are sold by Paddle, renew automatically, and can be cancelled online at any time. Your first payment is refunded in full if you ask within 14 days.
- You can download your data or delete your account from your profile whenever you like.
1. Who we are
Alcove is run by Victor Hugo da Silva Ribeiro, an individual based in Brazil ("we", "us"). If Alcove is moved to a company set up to run it, that company takes our place in these terms, and we'll let you know. You can reach us at [email protected].
2. Your account
- You must be at least 13 years old. If you're under 18, use Alcove only with permission from a parent or guardian, who accepts these terms on your behalf.
- An account is for one person. Give a real email address you can receive mail at, and keep your password to yourself.
- You're responsible for what happens under your account. If you think someone else has got into it, change your password and sign out of all devices from your profile, and tell us.
- Your display name and username are seen by other users. Don't pick ones that impersonate someone, mislead, or offend; we may ask you to change them, or change a username ourselves if you don't.
3. The service
Alcove lets you plan routines, time your focus, see your history and goals, follow friends and listen to the focus radio. We keep improving it, so features can be added, changed or removed. If we remove something a paid plan includes in a way that matters to you, you can cancel and get a refund for the time you haven't used.
We work to keep Alcove available and your data safe, and we back up the database daily. Still, the service may sometimes be down for maintenance or because of problems beyond our control. Work you do offline is kept on your device and sent when you're back online, but anything that never reaches our servers can be lost if your device's storage is cleared.
4. Acceptable use
When using Alcove, don't:
- break the law, or use Alcove to help someone else break it;
- harass, threaten or impersonate anyone, or put abusive, hateful or sexual content in anything other people can see;
- try to get into accounts, data or systems that aren't yours, or probe, scan or test Alcove's security without our written permission;
- overload or disrupt the service, or work around its limits, such as the AI assistant's daily and monthly allowance;
- collect data from Alcove with bots, scrapers or other automated means, or use the AI assistant for anything other than planning your routines;
- copy, resell or rent out Alcove, or reverse-engineer it except where the law allows.
5. Your content
The routines, tasks, tags, goals and other things you create in Alcove belong to you. You give us permission to store, copy, process and display them only as needed to run Alcove for you: syncing them across your devices, showing your stats, and showing other signed-in users the parts of your profile described in the Privacy Policy (your names, focus totals, streak, badges and connections). That permission ends when you delete your content or your account, apart from backups that expire on their own.
You can take a copy of your data at any time, under Account → Privacy options on your profile. Don't put content in Alcove that you don't have the right to use.
6. The AI routine assistant
- Plan with AI uses a third-party AI model to suggest routines. Its answers can be incomplete or wrong; nothing changes in your account unless you apply a suggestion yourself.
- It's a planning aid, not professional advice of any kind (medical, legal, financial or other).
- It has a usage allowance, shown in the app, and declines some requests for safety reasons.
- Don't send it sensitive personal data, such as health details, or other people's personal data.
7. Paid plans
Some features may need a paid plan. The plans, what each includes and their prices are shown on our site and at checkout before you buy. If you subscribe:
- The beta. While Alcove is in beta, every feature is free. Before any feature needs a paid plan, we'll tell you by email and in the app at least 30 days ahead, and nothing is charged unless you choose to subscribe. Accounts created during the beta keep a Founding Member badge on their profile.
- Paddle sells it. Our order process is run by our online reseller Paddle.com, which is the merchant of record for all our orders. Paddle handles payment, taxes, invoices and receipts, and its buyer terms apply to the purchase itself.
- Trial. We may offer a free trial. It doesn't ask for a payment method, and when it ends you choose whether to subscribe; nothing is charged unless you do.
- Renewal. Subscriptions renew automatically at the end of each period (monthly or yearly) and are charged to the payment method you chose, until you cancel.
- Cancelling. You can cancel online at any time, in the app or in Paddle's customer portal, with no need to contact us. Cancelling stops the next renewal; you keep the paid features until the end of the period you've paid for. We confirm every cancellation right away.
- Price changes. If a plan's price goes up, we'll tell you at least 30 days before your next renewal, so you can cancel before it applies.
- Non-payment. If a renewal can't be charged, the paid features may stop until payment goes through. Your data isn't deleted.
8. Refunds
- Your first payment for a plan is refunded in full if you ask within 14 days of it, for any reason. This covers your right of withdrawal under Brazil's Consumer Defense Code (art. 49, 7 days) and the EU and UK's 14 days.
- Later renewals aren't refunded for the time left in the period, since you can cancel before any renewal. Where the law of your country gives you a refund in other cases, you get it.
- If we end your access without a breach on your part, or close Alcove, we refund the part of the period you've paid for and won't get.
- To ask for a refund, use Paddle's customer portal (or reply to your Paddle receipt), or write to us. Refunds go back to the payment method you used.
9. Ending the agreement
You can stop using Alcove at any time and delete your account from your profile, which deletes your data as the Privacy Policy describes. Deleting your account doesn't cancel a paid subscription by itself: cancel it first, or write to us and we'll cancel it.
We may suspend or close an account that seriously or repeatedly breaks these terms, or that puts other users or the service at risk. Unless it's urgent or the law prevents it, we'll tell you why first and give you a chance to fix it or to download your data. If we ever decide to close Alcove, we'll give you at least 30 days' notice to download your data, and refund unused paid time.
10. Alcove's content
Alcove's software, design, name and logo belong to us. Using Alcove doesn't give you any rights in them beyond using the app under these terms. The music and sounds on the focus radio are used under the licenses listed on the Credits page in the app (on your profile); you may listen to them in Alcove but not download or redistribute them from it.
11. Warranties and liability
We provide Alcove with care, but as it is and as available: we don't promise it will be uninterrupted, error-free or suited to every purpose, and we're not responsible for how you use what it shows you or what the AI assistant suggests. As far as the law allows, we're not liable for indirect losses, such as lost profits or opportunities, and our total liability to you is limited to what you paid us in the 12 months before the claim.
None of this limits rights the law gives you as a consumer and that can't be waived, including under Brazil's Consumer Defense Code (Lei nº 8.078/1990) and the consumer law of the country you live in, nor our liability for fraud, gross negligence or anything else that can't legally be excluded.
12. Changes to these terms
We may update these terms, for example when we add features or plans, or when the law changes. We'll update the date at the top, and if a change is significant, we'll tell you by email or in the app at least 15 days before it takes effect. If you don't agree with a change, you can stop using Alcove, cancel your plan and delete your account before it applies. A change to the price of a plan you already have follows section 7.
13. Governing law and disputes
These terms are governed by the laws of Brazil. If you live elsewhere, you also keep the protection of the mandatory consumer laws of your country. If something goes wrong, write to us first; most problems can be solved that way. If not, you can take a dispute to the courts of the place where you live, or, in Brazil, to consumidor.gov.br or your state's Procon. EU consumers can also use their national consumer bodies.
